Förhandsanmälan om utstationerade arbetstagare införs från ingången av september

Regeringen godkände den 15 juni 2017 bestämmelserna om anmälan om utstationering av arbetstagare. Avsikten är att republikens president ska stadfästa lagen den 16 juni och att lagen ska träda i kraft den 1 juli 2017.

I och med den aktuella lagen möjliggörs införande av förhandsanmälan om utstationering av arbetstagare. Anmälan ska göras till arbetarskyddsmyndigheten. Syftet med anmälan är att göra den övervakning som genomförs av arbetarskyddsmyndigheterna mer målinriktad.

Utstationerade arbetstagare är arbetstagare som en arbetsgivare i en annan stat tillfälligt utstationerar i någon annan EU-medlemsstat för arbete där. I Finland finns det många utstationerade arbetstagare exempelvis inom byggbranschen.

I och med den nya lagen ska i princip varje utländskt företag som utstationerar arbetstagare till Finland innan arbetet påbörjas göra en anmälan till arbetarskyddsmyndigheten om att arbetstagare utstationeras till Finland på basis av ett avtal om tillhandahållande av tjänster över statsgränserna. Skyldigheten att göra förhandsanmälan träder i kraft den 1 september 2017.

Någon anmälan om utstationering av arbetstagare krävs inte om företaget utstationerar arbetstagare till Finland genom överföring inom företagsgruppen för högst fem arbetsdagar. Vid byggverksamhet är anmälan dock alltid en förutsättning för utförande av arbete.

Anmälan ska innehålla bl.a. identifieringsuppgifter och kontaktuppgifter för det utstationerande företaget, utländskt skattenummer och uppgifter om ansvariga personer i företagets etableringsstat, identifieringsuppgifter och kontaktuppgifter för beställaren, identifieringsuppgifter och kontaktuppgifter för byggherren och huvudentreprenören inom byggverksamhet, uppgift om det förväntade antalet utstationerade arbetstagare, identifieringsuppgifter och kontaktuppgifter i Finland för en företrädare för det utstationerande företaget eller grunden för att inte behöva utse en företrädare, datum för när utstationeringen börjar och dess förväntade varaktighet, uppgift om platsen där arbetet utförs samt uppgift om i vilken bransch den utstationerade arbetstagaren kommer att arbeta.

Om de uppgifter som meddelats tidigare ändras väsentligt, krävs det för att arbetet ska kunna fortgå att det utstationerande företaget gör en kompletterande anmälan omedelbart när ändringarna inträffar. Inom byggverksamhet krävs det för att arbete ska kunna utföras att en anmälan lämnas också till byggherren och huvudentreprenören.

Med tanke på införandet av förhandsanmälan har tekniska ändringar planerats bli gjorda i arbetarskyddsmyndighetens datasystem. I det nya tekniska systemet fyller ett utländskt företag som utstationerar arbetstagare till Finland i en elektronisk blankett på myndighetens webbplats. Blanketten inbegriper alla punkter om vilka upplysningar ska lämnas enligt lagen om utstationering av arbetstagare. De uppgifter som lämnats på blanketten sänds också till den e-postadress som anmälaren, dvs. det utstationerande företaget, har uppgett. Regionförvaltningsverket tar emot uppgifter också från privata serviceleverantörer.

Också det utstationerande företagets skyldighet att betala försummelseavgift för försummelse av förhandsanmälan sätts i kraft genom den nya lagen. Arbetarskyddsmyndigheten kan från och med den 1 september 2017 påföra det utstationerande företaget en försummelseavgift, om någon anmälan inte har gjorts eller om anmälan är bristfällig. Påföljdsavgift ska kunna påföras också om någon kompletterande anmälan inte har gjorts trots att det skett väsentliga ändringar.

Enligt lagen om utstationering av arbetstagare är försummelseavgiften minst 1 000 euro och högst 10 000 euro.

Lagen om utstationering av arbetstagare (447/2016) reviderades förra året. Lagen trädde i kraft den 18 juni 2016. Det s.k. tillämpningsdirektivet (direktivet om tillämpning av direktivet om utstationering av arbetstagare i samband med tillhandahållande av tjänster) sattes i kraft nationellt genom den reviderade lagen.
