Proposal to specify provisions on undercover activities conducted in information network by the police sent out for comments

The Ministry of the Interior has sent out for comments a government proposal aiming to specify the provisions concerning powers related to undercover activities conducted in an information network by the police. The deadline for submitting comments is October 16, 2025.

The aim of the proposed legislative amendment, which would specify the provisions on police powers, is to improve the state of crime prevention and to ensure that the regulation concerning secret methods of gathering intelligence and secret coercive measures is in this respect as aligned as possible.

The need to harmonise legislation is linked to the Act on Crime Prevention by the Finnish Border Guard that entered into force on 1 September 2025. The act grants powers to the Finnish Border Guard to carry out undercover activities exclusively in an information network. During the parliamentary proceedings on the act, questions were raised about the impact of expanding undercover activities in an information network on the application of the Police Act and the Coercive Measures Act.
