New EU thresholds in procurement legislation to enter into force on 1 January 2022

The European Commission has again reviewed the thresholds used in EU public procurement. The new thresholds will apply from the beginning of 2022.

The changes to the EU thresholds are based on the World Trade Organization’s (WTO) Government Procurement Agreement (GPA). The Commission reviews the EU thresholds every two years to correspond with the GPA.

The new thresholds will apply from the beginning of 2022. The EU thresholds will be updated on the website of the Ministry of Economic Affairs and Employment at the beginning of 2022. The thresholds do not include value-added tax due to the provisions concerning the estimated value of procurements. 

EU thresholds under the Public Procurement Act to rise

The Commission has raised the thresholds. For example, the threshold for goods and services contracts will rise from EUR 139,000 to EUR 140,000 for central government authorities, and from EUR 214,000 to EUR 215,000 for other contracting authorities (such as municipalities and parishes).

The threshold for building contracts will increase from EUR 5,350,000 to EUR 5,382,000.

Higher EU thresholds for contracts in special sectors

The thresholds for procurement of goods and services in special sectors that fall under the Act on public contracts in the utilities sector will rise from EUR 428,000 to EUR 431,000. In addition, the threshold for building contracts will increase from EUR 5,350,000 to EUR 5,382,000.

The thresholds for concession contracts in special sectors (services and public concession works) will rise from EUR 5,350,000 to EUR 5,382,000.

EU and national thresholds. Please note that the new EU thresholds will be updated on the website at the beginning of 2022. The current thresholds will remain in force until the end of December 2021.
